Opal Avenue (hereafter referred to as “Opal Avenue,” the “Site”, the “Services”, or “Website”) is committed to maintaining robust privacy protections for its users. Our Privacy Policy (“Privacy Policy”) is designed to help you understand how we collect, use and safeguard the information you provide to us and to assist you in making informed decisions when using our Services. For purposes of this Agreement, the terms “we”, “us” and “our” refer to the Site. “You,” “User,” and “Users” refer to you, as a user of the Service. By accepting our Privacy Policy and our Terms of Use (found here) you consent to our collection, storage, use and disclosure of your personal information as described in this Privacy Policy.

This Privacy Policy applies to your use of and access to all Opal Avenue websites (opalavenue.com) and any affiliated websites and sub-domains, as well as your use of any of the Services offered through Opal Avenue, including, but not limited to, product sales and marketplace, promotional and marketing offers, information resources, forums, reviews, ratings and blogs (collectively, the “Services” or “Service”). We collect information about you through our Services in an effort to improve your experience and to communicate with you about our Services, content and promotions. As described in this Privacy Policy, we may share your information internally, and under certain circumstances, with third parties that provide services on our behalf or with whom we have partnered to offer a particular service.

Please note that Opal Avenue is not responsible for the privacy practices of third party websites (even if we offer links to third party websites) and they are under no obligation to comply with this Privacy Policy. Before visiting another website and before providing any information to the party that operates or advertises on that third party website, Users should review the privacy policy and practices of that website to determine how information that they collect from users will be handled.

1. Information We Collect.

We collect “Non-Personal Information” and “Personal Information.” Non-Personal Information includes information that cannot be used to personally identify you, such as anonymous usage data, general demographic information we may collect, IP address, browser type, domain names, access times, site clicks and referring website addresses. This information is used for the operation of the Service, to maintain quality of the Service, and to provide general statistics regarding use of the Opal Avenue website. Personal Information includes your email, first and last name(s), which you submit to us through the registration process at the Site.

A.  Information you provide us by registering for an account.

In addition to the information provided automatically by your browser when you visit the Site, to become a subscriber to the Service you will need to create a personal profile and account. You can create a profile by registering with the Service and entering your email address, first and last name(s) and creating a password. By registering, you are authorizing us to collect, store and use your email address in accordance with this Privacy Policy.

B. If you purchase products through the Site.

You will provide further Personal Information as required by our payment processing partner, Square, and be subject to Square Terms of Use and Square Privacy Policy. Sensitive Personal Information requested in the course of the registration process may include an applicant’s Social Security Number, Date of Birth and Bank Details (“Sensitive Personal Information”). Sensitive Personal Information is not collected or stored by Opal Avenue’s systems, servers or otherwise and are passed over to Square directly by way of a secure encrypted connection.

C. If you register as a Vendor with Opal Avenue.

You will provide further Personal Information as required by our annual fee processing partner Stripe, and be subject to Stripe Terms of Use which includes Stripe Privacy Policy. Sensitive Personal Information requested in the course of the Vendor registration process may include an applicant’s Bank Details (“Sensitive Personal Information”). Sensitive Personal Information is not collected or stored by Opal Avenue’s systems, servers or otherwise and is passed over to Stripe directly by way of a secure encrypted connection.

2. How We Use And Share Information.

A. Personal information.

Except as otherwise stated in this Privacy Policy, we do not sell, trade, rent or otherwise share for marketing purposes your Personal Information with third parties without your consent. We do share Personal Information with vendors who are performing services for the Site, such as the servers for our email communications who are provided access to the user’s email address for purposes of sending emails from us. Those vendors use your Personal Information only at our direction and in accordance with our Privacy Policy. In general, the Personal Information you provide to us is used to help us communicate with you. For example, we use Personal Information to contact users in response to questions, solicit feedback from users, provide technical support, and inform users about content and promotional offers.

B. Non-personal information.

In general, we use Non-Personal Information to help us improve the Service and customize the user experience. We also aggregate Non-Personal Information in order to track trends and analyze use patterns on the Site. This Privacy Policy does not limit in any way our use or disclosure of Non-Personal Information and we reserve the right to use and disclose such Non-Personal Information to our partners, advertisers and other third parties at our discretion. In the event we undergo a business transaction such as a merger, acquisition by another company, or sale of all or a portion of our assets, your Personal Information may be among the assets transferred. You acknowledge and consent that such transfers may occur and are permitted by this Privacy Policy, and that any acquirer of our assets may continue to process your Personal Information as set forth in this Privacy Policy. If our information practices change at any time in the future, we will post the policy changes to the Site so that you may opt out of the new information practices. We suggest that you check the Site periodically if you are concerned about how your information is used.

3. Use of Cookies.

The Site may use “cookies” to help you personalize your online experience. A cookie is a text file that is placed on your hard disk by a web page server. Cookies cannot be used to run programs or deliver viruses to your computer. Cookies are uniquely assigned to you, and can only be read by a web server in the domain that issued the cookie to you. One of the primary purposes of cookies is to provide a convenience feature to save you time. The purpose of a cookie is to tell the Web server that you have returned to a specific page. For example, if you register with the Site, a cookie helps Opal Avenue to recall your specific information on subsequent visits. This simplifies the process of recording your personal information, such as billing addresses, shipping addresses, and so on. You have the ability to accept or decline cookies. Most Web browsers automatically accept cookies, but you can usually modify your browser setting to decline cookies if you prefer. If you choose to decline cookies, you may not be able to fully experience the interactive features of Opal Avenue Services or Site.

4. Your Rights.

If you are located in certain parts of the world, including California and countries that fall under the scope of the European General Data Protection Regulation (aka the “GDPR”), you may have certain rights regarding your personal information, like the right to request access to or deletion of your data.

If you are located in a country that falls under the scope of the GDPR, data protection laws give you certain rights with respect to your personal data, subject to any exemptions provided by the law, including the rights to:

California Consumer Privacy Act (CCPA)

The California Consumer Privacy Act (“CCPA”) requires us to provide California residents with some additional information about the categories of personal information we collect and share, where we get that personal information, and how and why we use it.

The CCPA also requires us to provide a list of the “categories” of personal information we collect, as that term is defined in the law, so, here it is. In the last 12 months, we collected the following categories of personal information from California residents, depending on the Services used:

  • Identifiers (like your name, contact information, and device and online identifiers);
  • Commercial information (your billing information and purchase history, for example);
  • Characteristics protected by law (for example, you might provide your gender as part of a research survey for us);

If you are a California resident, you have additional rights under the CCPA, subject to any exemptions provided by the law, including the right to:

  • Request to know the categories of personal information we collect, the categories of business or commercial purpose for collecting and using it, the categories of sources from which the information came, the categories of third parties we share it with, and the specific pieces of information we collect about you;
  • Request deletion of personal information we collect or maintain;
  • Opt out of any sale of personal information; and
  • Not receive discriminatory treatment for exercising your rights under the CCPA.

The CCPA & Personalized Advertising in Our Ads Program

Our mission is to democratize publishing and commerce, and that means making our Services accessible to as many people as possible. We show ads on some of our users’ sites as well as some of our own sites, and the revenue these ads generate lets us offer free access to some of our Services so that money doesn’t become an obstacle to having a voice. Our ads program also allows our users to earn revenue to support and grow their own sites. As part of our advertising program, we and our users do use cookies to share certain device identifiers and information about your browsing activities with our advertising partners, and those advertising partners may use that information to show you personalized ads on some of our users’ sites and some of our own.

The personal information we share includes online identifiers; internet or other network or device activity (such as cookie information, other device identifiers, and IP address); and geolocation data (approximate location information from your IP address). These disclosures may be considered a “sale” of information under the CCPA. We do not sell (or share) information through our ads program that identifies you personally, like your name or contact information. We don’t knowingly sell personal information of those under 18.

Contacting Us About These Rights

You can usually access, correct, or delete your personal data using your account settings and tools that we offer, but if you aren’t able to or you’d like to contact us about one of the other rights, scroll down to “Contact Us” and send us a message.

When you contact us about one of your rights under this section, we’ll need to verify that you are the right person before we disclose or delete anything. For example, if you are a user, we will need you to contact us from the email address associated with your account. You can also designate an authorized agent to make a request on your behalf by giving us written authorization. We may still require you to verify your identity with us.

You have the right at any time to prevent us from contacting you for marketing purposes. When we send a promotional communication to a user, the user can opt out of further promotional communications by following the unsubscribe instructions provided in each promotional email. Please note that notwithstanding the promotional preferences you indicate by unsubscribing, we may continue to send you administrative and transactional emails including, for example, purchases made through the Services and periodic updates to our Privacy Policy.

5. How We Protect Information.

A. We implement security measures designed to protect your information from unauthorized access, including but not limited to SSL encryption (https) everywhere where we deal with personal data. Your account is protected by your account password and we urge you to take steps to keep your personal information safe by not disclosing your password and by logging out of your account after each use. We further protect your information from potential security breaches by implementing certain technological security measures including encryption, firewalls and secure socket layer technology. However, these measures do not guarantee that your information will not be accessed, disclosed, altered or destroyed by breach of such firewalls and secure server software. By using our Service, you acknowledge that you understand and agree to assume these risks.

B. Age limitation

Opal Avenue does not knowingly collect personally identifiable information from minors under the age of 18. Our Services are intended solely for persons who are 18 or older. Any access to or use of our Services by anyone under 18 is expressly prohibited. By accessing or using our Services you represent and warrant that you are 18 or older.

6. Third Party Websites

As part of the Service, we may provide links to or compatibility with other websites or applications. However, we are not responsible for the privacy practices employed by those websites or the information or content they contain. This Privacy Policy applies solely to information collected by us through the Site and the Service. Therefore, this Privacy Policy does not apply to your use of a third party website accessed by selecting a link on our Site or via our Service. To the extent that you access or use the Service through or on another website or application, then the privacy policy of that other website or application will apply to your access or use of that site or application. We encourage our users to read the privacy statements of other websites before proceeding to use them.

7. Responding to “Do Not Track” Signals.

“Do Not Track” or DNT is a feature enabled on some browsers that sends a signal to request that a web application disable its tracking or cross-site user tracking. At present, our Site does not respond to or alter its practices when a DNT signal is received.

8. Changes to Our Privacy Policy.

The Site reserves the right to change this policy and our Terms of Service at any time. We will notify you of significant changes to our Privacy Policy by sending a notice to the primary email address specified in your account or by placing a prominent notice on our site. Significant changes will go into effect 30 days following such notification. Non-material changes or clarifications will take effect immediately. You should periodically check the Site and this privacy page for updates.
